So if I made a sketch of Gateshead Town Hall and made t-shirts with it on, would they be able to stop me? Seems like it's the same thing. It's my own representation of a public thing in a public space.
I'm not overly hot on this, but I think it's an issue as to the rights of the likeness. New York, for instance probably has lawyers who's sole job is to stop people making stuff with the Statue of Liberty on it.
I'm sure someone here has a firmer grasp on these things than me, though; it may well be to do with whether they're generating revenue from the likeness or not.
The worse case is that you will get a cease and desist letter that generally gives you 60 days to, erm, cease and desist. Seeing as you are selling a likeness of something that must be 'owned' by somebody I think you could be on sticky ground but you aren't going to end up being financially penalised or sent to prison so I'd say just go ahead and worry about the consequences after.
Obviously the above advice is based on you not using this image as the sole foundation of your enterprise.
Can I ask for a bit more advice re. my question above.
In a few weeks a new artistic landmark is opened to the public. The Kelpies (Google them... I can't do links with my mobile ) are massive horses head sculptures. I quite fancy cashing in on this by selling prints and teeshirt of my illustrations of these.
I could do this by getting them printed and marketing them myself or it has been suggested I try and work a deal with the local community trust that owns and operates the Kelpies. They could use my design for a cut of the profits.
Any of you have any experience with this kind of thing?
Contacted local Community Trust. They won't be producing merchandise until 2015 because that's when the giftshop opens! What's that? Is that the sound of a boat being missed. The place opens in three weeks to a fanfare of publicity. Idiots.
I'm still swithering about just investing a few hundred quid in a decent tabletop screenprinting kit and making a go of it. It's like that old saying about giving a man a fish etc. If' i'm spending £200-300 getting a batch of tees made then I'm just keeping someone else in business. If I do it for myself then I'm starting my own business. I'm currently inbetween jobs right now anyway.
yup, ive personally encoutered about 90% of those.
Edit
Actually I should submit my personal favourite:
I'm sending you a brief, I'ts been sitting on my desk for nearly two weeks.

Today I had a client saying she wasn't sure about a table top in a render I had done.
It was off white and changed to pale grey. She was looking at a jpg on a blackberry while driving around Brighton.
Gawd. How do you patiently and politely explain to someone that they are an idiot?
