The Ideas programme was different because they were submitted so the person submitting signed up to the terms of doing so.
That said I'm not sure how much ownership somebody would have over something they had made unless they had created instructions etc which Lego had completely ripped brick for brick.
There is a cottage industry of people selling their own kits or instructions.
I'm not sure why you get so uptight about what other people do with their Lego. It is still possible to enjoy in the same way as it was in the 70s.
